An EEA Family residence permit visa for the UK is meant for EEA Nationals and their dependents and permits EEA Nationals and their dependents the right to live and work in the UK. This permit allows the holder to work in the UK, accept offers of employment or manage/open a UK based company.

 

Residing or working in the UK allows the holder to undertake employment without any need for sponsorship or UK Work Permit. Provided that you or your spouse are a member of an EEA Member country and you can support yourself and any dependents in the UK this visa is an easy route to living and working in the UK. You can live in the UK as a student without the need for Tier4-Student Visa.

 

After spending 4 out of the 5 years in the UK, EEA Family Permit Holders may be eligible to apply for Indefinite Leave to Remain (Permanent Residence) in the UK.

In order to be eligible for this type of Visa you need to be a national of 1 of the countries listed below, you must also be able to show that you can support yourself and any dependents in the UK without access to public funds.

 

There is a 2 stage process for the EEA Family Visa and once initially granted will be valid for a 6 month period. Once inside the United Kingdom there is the possibility to extend this status into what is known as EEA2 or a residence card application, this residence card will confirm the right to live, work and reside in the United Kingdom.

Residence cards are valid for a period of 5 years after which the applicant may aply for a permanent residence card or status.

FAMILY VISA UK

Fiancé Visa

 

A UK Fiancé Visa or spouse visa enables your Fiance to join them in the UK provided that they have settled status as a permanent resident or British Citizen.

 

Fiance visas are generally issued for an initial period of 6 months and are issued only for the purpose of travelling to the UK to get married.


After the marriage the applicant may apply to stay in the country beyond the 6 month period and generally a 2 year extension may be issued in the form of a marriage visa. After the 2 year period it may be possible to apply for indefinite leave to remain/residency in the UK as long as the marriage still exists.

 

For a UK Fiancé visa application, applicants must be 21 years of age or over and the partner with settled status in the United Kingdom must be 21 yrs of age or older.
 

In order to be eligible for the fiancé visa service, partners must fulfill the following requirements:

  • Plan to marry within a reasonable time (usually six months)

  • Plan to live together permanently after they married

  • Have met each other
     

Be able to support themselves entirely without assistance from public funds

Have adequate accommodation for the applicant and any dependents to live until they are married without assistance from public fund

Only after an applicant’s fiancé visa is changed over to a 2 year marriage visa will they be able to start working and hold the same rights as their spouse who is present and settled in the United Kingdom.  After the 2 year period however applicants will be able to work without restriction.

Marriage/Spouse/UK Settlement Visa

 

A UK Settlement/Marriage/Spouse Visa enables your husband, wife or civil partner to apply to join or remain in the UK provided they are married to a person who is present and settled in UK. Both partners in the marriage need to be 21 before a marriage visa can be issued. Applicants under this visa must apply for entry clearance before travelling to the UK.

 

Marriage visas are generally issued for an initial period of 2 years, after this time, applicants may apply for Indefinite Leave to Remain (ILR) otherwise known as residency in the UK.

 

 A UK Marriage Visa allows the applicant to look for and take up employment in the UK as soon as they arrive in the country, there is no need to arrange a UK sponsor or Work Permit and there are no restrictions on the type of work that can be undertaken.

 

For a Marriage Visa application, applicants must be 21 years of age or over and the partner with settled status in the United Kingdom must be 21 years of age or older.

 

In order to be eligible for the Marriage visa, partners must fulfill the following requirements:

 

  • Parties have to be legally married to each other

  • Plan to live together permanently after they married

  • Have met each other
     

Meet the Financial Thresholds set out by the UKBA that currently states that an amount of:

 

  • £18,600 for each year for the main applicant

  • £22,400 if you’re including 1 child as a dependent

  • £2,400 for each additional child member of the family


Be able to support them entirely without assistance from public funds.


Have adequate accommodation for the applicant and any dependents to live until they are married without assistance from public funds.


Meet the English Language Requirement

 

Any children of the marriage under 18 years of age will be granted entry to the UK as dependents. Dependents can make their applications at the same time as the main applicant, after a period of three years in the UK, if they still meet the residence requirements, may then apply for British Naturalization and Citizenship.
